On the last adjourned date, the AG conceded and said they are not opposed to our statement of case that deals with section 16 of Act 30. The provision stipulates “Officers in charge of the police station, shall report monthly to the District Magistrate the cases of all persons arrested without warrant within the limits of their respective stations and not subsequently charged with in an office, whether those persons have been admitted to bail or not”
What the law seeks to achieve is to ensure that all forms of arrest by the Police and other institutions of State with arresting powers such as the BNI & SPO, must be brought under the surveillance eye of our trusted Judiciary and her Courts.
Judgment to be delivered on the March 30, 2018.
